DISTANCE SALES AGREEMENT

All users are deemed to have read, understood, and accepted this Distance Sales Agreement upon completing their membership registration and placing an order through the Ginger Cat online store.

ARTICLE 1 – SUBJECT

The subject of this Agreement is the determination of the rights and obligations of the Seller and the Buyer regarding the sale and delivery of the products purchased electronically through the Ginger Cat online store, in accordance with applicable consumer protection laws and regulations governing distance contracts.

ARTICLE 2 – SELLER INFORMATION

Company information, registered address, tax office, tax number, telephone number, and e-mail address shall be provided in the relevant sections of the website.

ARTICLE 3 – BUYER INFORMATION

The Buyer refers to any individual or legal entity who becomes a member of the Ginger Cat online store and purchases products through the website.

ARTICLE 4 – PRODUCT INFORMATION

The type, quantity, model, specifications, sales price, payment method, and delivery information of the purchased products are as specified on the website and in the order confirmation.

In the event of technical, software, or pricing errors, Ginger Cat reserves the right to cancel the order after informing the Buyer.

ARTICLE 5 – GENERAL PROVISIONS

5.1

The Buyer declares that they have read and understood all information regarding the essential characteristics, sales price, payment method, delivery conditions, and other relevant details of the purchased product before completing the order.

5.2

The purchased product shall be delivered to the Buyer or the recipient designated by the Buyer within the legal delivery period, provided that such period does not exceed thirty (30) days.

5.3

The Seller shall not be held responsible if the recipient designated by the Buyer refuses to accept delivery.

5.4

The Seller is responsible for delivering the product complete, undamaged, and in accordance with the specifications stated in the order.

5.5

The Seller's obligation to deliver the product is subject to full payment of the order amount. If the payment is not completed or is cancelled by the payment provider, the Seller shall have no obligation to deliver the product.

5.6

If the payment for the product is reversed or cancelled due to unauthorized use of the Buyer's payment method, and the Seller does not receive payment, the Buyer shall return the product within three (3) business days. Return shipping costs shall be borne by the Buyer.

5.7

In the event of force majeure, transportation disruptions, severe weather conditions, or other circumstances beyond the Seller's control, the Seller may postpone delivery. The Buyer may choose to:

Cancel the order,

Request a replacement product of equivalent value (if available),

Accept a delayed delivery.

If the order is cancelled, the Seller shall initiate the refund process promptly through the payment provider.

5.8

Any defective, damaged, or incorrect product must be reported to the Seller immediately after delivery. The Buyer shall follow the instructions provided by the Seller regarding replacement, repair, or return procedures.

5.9

This Agreement becomes effective electronically upon confirmation of the order by the Buyer.

DELIVERY INSPECTION

The Buyer is strongly advised to inspect the package and product in the presence of the courier before accepting delivery.

If any shipping-related damage is observed, the Buyer should request a damage report from the courier and refuse acceptance of the shipment.

Claims for transportation damage may be rejected by shipping carriers if no report is prepared at the time of delivery.

RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the contract within fourteen (14) days from the date of delivery without providing any reason, except for products excluded under applicable consumer protection regulations.

To exercise the right of withdrawal:

The Seller must be notified in writing via e-mail within the withdrawal period.

The product must be returned unused, complete, and in its original packaging.

Any accessories, manuals, promotional items, and invoices supplied with the product must also be returned.

The Buyer shall be responsible for any decrease in value resulting from handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods.

Upon receipt and inspection of the returned product, the Seller shall process the refund in accordance with applicable law.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to products that are:

Custom-made or personalized for the Buyer.

Produced on demand according to the Buyer's specifications.

Unsealed software, digital content, or downloadable products after delivery.

Products that cannot be returned due to their nature under applicable legislation.

Products that have been used, modified, assembled, painted, or otherwise altered after delivery.

MODEL KITS AND RESIN PRODUCTS

The Buyer acknowledges that scale model kits, resin parts, photo-etched components, decals, and related hobby products may require assembly, modification, sanding, drilling, painting, or other modeling techniques.

Minor manufacturing variations that do not affect the intended use of the product shall not be considered defects.

The Buyer is responsible for using appropriate tools, adhesives, paints, and safety equipment during assembly.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Republic of Türkiye.

In disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts having jurisdiction under applicable Turkish consumer protection legislation shall be authorized.

By placing an order electronically, the Buyer acknowledges that they have read, understood, and accepted all provisions of this Agreement.
